Action Alert: CAIR Urges Senate to Vote ‘No’ on Torture-Supporting Judicial Nominee Howard Nielson

(WASHINGTON, D.C., 1/5/18) -- The Council on American-Islamic Relations (CAIR), the nation’s largest Muslim civil rights and advocacy organization, today called on members of the Senate Judiciary Committee to vote “NO” on the nomination of Howard C. Nielson to the position of United States District Court Judge for the District of Utah because of his past support for torture.

CAIR is also calling on American voters to urge the Senate Judiciary Committee, and their state’s Senate delegation, to oppose Nielson’s nomination.

Prior to his nomination, Nielson, serving as a Bush Administration Justice Department deputy assistant attorney general, authored an August 2005 memo used to justify torture, arguing that “persons captured and detained in Afghanistan do not qualify for ‘protected person’ status under the Geneva Convention.”

Nielson’s memo was written in part to support the conclusions of the Bush Administration’s “Torture Memos” – a series of legal memos erroneously providing legal defenses for the Bush Administration’s use of rendition, indefinite detention, torture and abuse of detainees in U.S. custody; including the use of waterboarding.

The Senate Judiciary Committee may hear and vote on Nielson’s nomination as early as Wednesday, January 10.

“The Senate has a moral obligation to reject judicial nominees who provided legal justifications for the United States’ past use of torture -- especially when they are being nominated by a president who has pledged to bring back waterboarding and much worse,” said CAIR Government Affairs Director Robert S. McCaw.

In 2007, Nielson wrote a Washington Post editorial defending the Bush Administration’s Department of Justice Office of Legal Counsel (OLC), and former Acting Assistant Attorney General Stephen Bradbury, his previous supervisor, in response to national media revealing the existence of the torture memos and torture of detainees.

Bradbury was one of the primary authors of the OLC’s torture memos, and in Nielson’s editorial, he hinted at his own involvement assisting Bradbury in drafting some of these memos.

In 2006, the Bush administration banned waterboarding, and in 2009, President Barack Obama signed an executive order banning waterboarding and other harsh interrogation tactics.

However, President Donald Trump supported the use of torture on the campaign trail stating if elected president, “I would bring back waterboarding” … “And I would bring back a hell of a lot worse than waterboarding.”

ACTION ALERT: CAIR-Florida Calls on the Republican Party of Polk County to Drop Anti-Muslim Presentation

(MIAMI, FL, 1/2/18) – The Florida chapter of the Council on American-Islamic Relations –Florida (CAIR-Florida), the state’s largest Muslim civil liberties and advocacy organization, today called on the Republican Party of Polk County to denounce the Florida Republican Club of Lakeland’s scheduled anti-Muslim presentation by Jeffrey Sanow.

According to Lakeland’s GOP Club website, Sanow’s presentation will focus on what sharia (Islamic principles) really means and how it is incompatible with the United States’ Constitution. The event will be part of the Club’s board of directors’ election scheduled for January 3rd at the Cleveland Heights Golf and Country Club in Lakeland, Fla.

CAIR-Florida said the Lakeland’s Republican Club’s invitation to Jeffrey Sanow to discuss matters of Islam and sharia is really meant to deceive attendees and arouse hate toward the religion of Islam and American Muslims. 

In a statement, CAIR-Florida’s Central Florida Regional Director Rasha Mubarak said:

“We wonder what kind of expertise Mr. Sanow has about Islam and Islamic law? He has already stated that, ‘Americans must reclaim their religious heritage if we are to roll back the onslaught of Islam’, ‘Sharia continues to creep into our courts, legislature, schools and companies’, and ‘The foundation of Islam is retribution.’ Who knows what other anti-Islamic rhetoric he will spew to get his misguided message across?

“We are asking the Republican Party of Polk County to ensure that the Lakeland’s GOP club members immediately cancel this presentation. They should also send a clear message to the state’s officers, clubs and organizations to reject any kind of platforms for anti-Muslim and xenophobic speakers.”

CAIR-Florida is also calling on concerned community members to take action by emailing the Republican Party of Polk County and the Republican Club of Lakeland to drop Sanow as its featured guest speaker.

CAIR Action Alert: Support the ‘Promoting Human Rights by Ending Israeli Military Detention of Palestinian Children Act’

(WASHINGTON, D.C., 11/14/17) -- The Council on American-Islamic Relations (CAIR), the nation’s largest Muslim civil rights and advocacy organization, is urging American Muslims and all people of conscience to urge their elected representatives in the U.S. House to support the Promoting Human Rights by Ending Israeli Military Detention of Palestinian Children Act.

Introduced by Congresswoman Betty McCollum (D-MN), the act is jointly support by original co-sponsors Representatives Mark Pocan (D-WI), Earl Blumenauer (D-OR), André Carson (IN-D), John Conyers, Jr. (D-MI), Danny K. Davis (D- IL), Peter A. DeFazio (D-OR), Raul Grijalva (D-AZ), Luis V. Gutiérrez (D-IL), and Chellie Pingree (D-ME).

“This legislation highlights Israel’s system of military detention of Palestinian children and ensures that no American assistance to Israel supports human rights violations,” said Congresswoman McCollum in a press release issued by her office. “Peace can only be achieved by respecting human rights, especially the rights of children. Congress must not turn a blind eye the unjust and ongoing mistreatment of Palestinian children living under Israeli occupation.”

The Promoting Human Rights by Ending Israeli Military Detention of Palestinian Children Act asserts that the “Israeli military detains around 500 to 700 Palestinian children between the ages of 12 and 17 each year and prosecutes them before a military court system that lacks basic and fundamental guarantees of due process in violation of international standards” and “Since 2000, an estimated 10,000 Palestinian children have been detained by Israeli security forces in the West Bank and prosecuted in the Israeli military court system.”

The act also cites Human Rights Watch’s July 2015 report “Israel: Security Forces Abuse Palestinian Children,” that found such detentions also included the use of chokeholds, beatings, and coercive interrogation on children between the ages of 11 and 15 years.

November 9 marks more than two months since President Donald Trump ended Deferred Action for Childhood Arrivals (DACA) program, and one year since he was elected into office. The time is now, and November 9th will be the day on which America tells Congress: we demand a clean Dream Act by December!

In September, CAIR condemned President Trump’s termination of the DACA program as “pandering to the demands of anti-immigrant extremists.”

DACA is the Obama-era federal administrative relief from deportation policy that protects the rights of some 800,000 undocumented young people, commonly referred to as “Dreamers,” brought to the United States as children. Since President Obama established the DACA program in 2012, it has opened a path for over three quarter of a million-young people in the United States to cultivate their business ideas, serve in the military, advance their education, and contribute to our country in innumerable ways.
