(WASHINGTON, D.C., 8/16/19) — The Council on American-Islamic Relations (CAIR), the nation’s largest Muslim civil rights and advocacy organization, today called on President Trump to withdraw the nomination of Steven Menashi to the United States Court of Appeals for the Second Circuit following reports that he argued in a law-review article that “ethnonationalism remains a common and accepted feature of liberal democracy that is consistent with current state practice and international law.”
Last night, MSNBC host Rachel Maddow reported that in his 2010 law-review article titled “Ethnonationalism and Liberal Democracy,” Menashi put forward the racist idea that “Self-government requires a political partnership in which individuals are willing and able to regard one another as equal members of the policies community. . .democratic self-government depends on national fellow-feeling: the capacity of citizens to identify with each other. . .Ethnic ties provide the groundwork for social trust and political solidarity.”

Menashi promoted the racist argument that, “Ethnically heterogeneous societies exhibit less political and civic engagement, less effective governing institutions, and few public goods.”
Maddow reported that Manashi also repeated the Islamophobic online myth, favored by President Trump, about U.S. Gen. John Pershing executing Muslim prisoners in the Philippines with bullets dipped in “pigs’ blood.”

“While our nation confronts the growing threat of white supremacy and white nationalism, it is unconscionable that President Trump would advance a racist Islamophobe like Menashi to a lifetime judicial position,” said CAIR Director of Government Affairs Department Robert McCaw. “American democracy is founded on the principle that our rich national diversity is to be celebrated and that we as a people are united by our shared experiences and principles, not by our race or ethnicity.”
CAIR has witnessed an unprecedented spike in bigotry targeting American Muslims, immigrants and members of other minority groups since the election of Donald Trump as president. CAIR has repeatedly expressed concern about Islamophobic, white supremacist and racist Trump administration policies and appointments.
