CAIR Action Alert: Urge the Senate to Keep ‘Nonprofit Killer Bill’ Out After It Was Dropped from House Tax Package

The Council on American-Islamic Relations (CAIR), the nation’s largest Muslim civil rights and advocacy organization, today welcomed the removal of the dangerous and unconstitutional “Nonprofit Killer Bill” provision from the final House-passed Republican tax package.

CAIR is now urging all Americans to contact the U.S. Senate to ensure this provision is not revived during its deliberations.

The House’s “One Big Beautiful Bill Act” excluded Section 112209, originally advanced by the House Ways and Means Committee. Known as the “Nonprofit Killer Bill,” this provision would have given the Treasury Secretary broad, unchecked power to revoke nonprofit tax-exempt status based on vague and politically motivated accusations of “terrorism support,” often relying on classified evidence and without due process.

Although there were concerns the provision might be reinserted during House deliberations, it was ultimately dropped after the Senate Parliamentarian signaled it would violate the Byrd Rule, which limits non-budgetary measures in reconciliation bills. While it is not included in the Senate version, CAIR warns the provision could still resurface in future legislation and urges senators to reject any attempt to revive it.

The House’s removal of Section 112209 follows additional advocacy victories: both the Antisemitism Awareness Act and Anti-Boycott IGO Act recently failed to advance amid rising concern over their free speech implications.

In a statement, CAIR Government Affairs Director Robert S. McCaw said:

“The House’s decision to drop the Nonprofit Killer Bill is a major victory for free speech and nonprofit advocacy. However, this fight is far from over. The Senate must shut the door on this dangerous provision once and for all.

“Let’s be clear: this and similar bills, including the misleadingly titled Antisemitism Awareness Act and the Anti-Boycott IGO Act, are not about security or hate prevention. They are about silencing dissent, punishing Palestinian rights advocates, and giving the government unchecked power to target nonprofits based on politics, not facts.

“These congressional attacks represent an authoritarian attempt to erode First Amendment rights under the false pretense of combating extremism. The nonprofit sector is the backbone of American civil society, not a scapegoat for political agendas. The congress must continue to reject these threats in every form, now and in the future.”

Previously introduced as H.R. 9495 and H.R. 6408, the “Nonprofit Killer Bill” has faced strong opposition from over 100 civil rights, religious, and nonprofit organizations. CAIR warns the provision would:

  • Grant the Treasury Secretary broad discretionary power to revoke tax-exempt status based on subjective and politically motivated criteria.
  • Suppress protected speech, targeting organizations advocating for Palestinian rights and other social justice causes.
  • Violate due process by allowing the use of classified evidence without giving nonprofits the chance to challenge it.
  • It is unnecessary, as existing U.S. laws already prohibit terrorism financing without infringing on civil liberties.

Last year, CAIR joined 100 organizations in a letter to House Speaker Mike Johnson, stating that the Nonprofit Killer Bill “poses a direct threat to the constitutional rights of any American nonprofit, house of worship, or advocacy organization.”

CAIR also joined 135 civil liberties and human rights groups in a letter to the Senate Finance Committee opposing another version of the act.

CAIR will continue to urge all concerned Americans to take action and urge their members of Congress to oppose the advancement of this act, and its dangerous goals. CAIR remains committed to challenging this legislation in all its iterations and forms and will continue to advocate for the protection of nonprofit organizations’ rights to free speech, due process, and equal treatment under the law.
