On Monday, March 11, the Council on American-Islamic Relations (CAIR), the nation’s largest Muslim civil rights and advocacy organization, will offer oral argument in the U.S. Court of Appeals for the Fifth Circuit case Kovac v. Wray, No. 23-10284.

BACKGROUNDER:
Kovac challenges the legality of the federal terrorist watchlist based on the “major questions doctrine.” The Supreme Court has explained that, when a federal agency claims extraordinarily broad power to infringe on individual liberty, that agency must show that Congress expressly authorized that power.
A CAIR attorney will argue that this “major questions doctrine” applies to the federal terrorist watchlist because federal agencies assert the authority to place an unlimited number of people on the watchlist. CAIR will also argue that the watchlist is illegal because Congress has not expressly authorized federal agencies to create, maintain, or use the list.
