CAIR Calls SCOTUS Ruling Limiting Federal Court Nationwide Injunctions ‘Recipe for Judicial Chaos, Abuses of Power’

The Council on American-Islamic Relations (CAIR), the nation’s largest Muslim civil rights and advocacy organization, today called a U.S. Supreme Court ruling that lower courts lack the authority to grant nationwide injunctions to block President Trump’s executive order to end birthright citizenship “a recipe for both judicial chaos and more abuses of power.”

In a statement, CAIR National Deputy Director Edward Ahmed Mitchell said:

“The Supreme Court’s decision to limit a federal court’s ability to issue nationwide injunctions, even in cases involving blatantly unconstitutional actions that threaten people across America, like President Trump’s birthright citizenship order, is a recipe for both judicial chaos and more abuses of power.

“Every single American threatened by a White House’s blatantly unconstitutional executive orders should not be forced to sue to protect their rights, and most Americans lack the expertise or resources to do so. As Justice Jackson correctly noted, ‘The Court’s decision to permit the Executive to violate the Constitution with respect to anyone who has not yet sued is an existential threat to the rule of law.’”
