CAIR-NY Condemns Fatal Beating of Robert Brooks at Marcy Correctional Facility, Calls for Accountability and Systemic Reforms

The New York chapter of the Council on American-Islamic Relations (CAIR-NY), a chapter of the nation’s largest Muslim civil rights and advocacy organization, today called for accountability following the beating of Robert Brooks by 14 correctional officers and staff at Marcy Correctional Facility in Oneida County, New York. Brooks, a 43-year-old African American man, died from his injuries on December 10, one day after the violent incident.

The body camera footage, released last week, reveals the correctional officers choking, kicking, and punching Brooks, as well as dragging his limp body across a room. 4 of those 14 officers were wearing body cameras but were not turned on. A preliminary medical examiner’s report suggests asphyxia due to compression of the neck as the cause of death, with the actions of the officers being a contributing factor. A vigil for Brooks was held Monday, and Letita James, New York Attorney General, recused her office, citing a conflict of interest due to prior litigation in which her office is representing several officers. Special Prosecutor William J. Fitzpatrick, Onondaga County District Attorney has been appointed to further investigate.

CAIR-NY Executive Director Afaf Nasher, Esq. Stated:

“Robert Brooks’ tragic death is a stark reminder of the systemic racism and unchecked violence that plague our criminal justice system. We extend our condolences to Mr. Brooks’ family during this difficult time. CAIR-NY also stands in solidarity with all those calling for justice and a thorough investigation into his death. This atrocity must lead to meaningful change to protect the dignity and lives of all incarcerated individuals.”

CAIR-NY echoes the Brooks family and allied organizations in demanding:

Criminal charges against all individuals involved in Brooks’ death.  Independent investigations into systemic abuse and racial bias at Marcy Correctional Facility conducted by the newly appointed prosecutor, FBI, and other agencies with authority.
