(PHOENIX, AZ, 6/16/2022) – The Arizona chapter of the Council on American-Islamic Relations (CAIR-AZ) today called for state legislative action to remove racist community rules in real estate covenants.
A Tucson man who placed an offer on a home in the city’s San Gabriel Park neighborhood discovered a rule banning selling, renting or leasing of the property to Black people in the Covenants, Conditions and Restrictions (CC&R’s) attached to the property’s deed. The man said he asked for more updated documents but was told there were none. The rules, which were approved in 1946, are no longer enforceable under Arizona law.
“These community rules are in complete opposition to the Constitution and Arizona’s values,” said CAIR-AZ Executive Director Azza Abuseif. “We urge state lawmakers to take legislative action to remove racist rules from all covenants in Arizona.”
She noted that CAIR has previously supported efforts to remove racist language from housing covenants in Idaho, Wyoming and Nevada.
